Auto Car Finder Terms of Service

These Terms of Service govern your access to and use of the Auto Car Finder platform, including our website, vehicle listings, dealer tools, lead features, advertising services, and related marketplace functionality. By using our platform, you agree to these Terms.

1. About Auto Car Finder

Auto Car Finder is an online vehicle marketplace that connects buyers, sellers, dealers, and dealer groups. We provide vehicle listing tools, search tools, advertising products, lead generation tools, moderation tools, finance-related calculators, and related services through our website and platform.

Unless expressly stated otherwise, Auto Car Finder is not the owner, seller, reseller, broker, or financier of the vehicles advertised by third parties on the platform.

2. Who these Terms apply to

These Terms apply to all users of the platform, including:

  • visitors and browsers;
  • private sellers;
  • dealers and dealer groups;
  • buyers and prospective buyers;
  • advertisers and business users.

If you use the platform for a dealership, company, or other entity, you confirm that you are authorised to bind that entity to these Terms.

3. Eligibility

You may only use Auto Car Finder if you:

  • are at least 18 years old or otherwise have legal capacity;
  • provide accurate information where required;
  • use the platform in compliance with these Terms and applicable law.

4. Our services

Auto Car Finder may provide services including:

  • vehicle listing and advertising tools;
  • dealer profile and dealership listing tools;
  • vehicle search, filtering, and comparison tools;
  • listing boosts, featured placements, and advertising products;
  • lead generation and enquiry tools;
  • finance, affordability, or repayment calculators;
  • duplicate detection, fraud prevention, and moderation tools;
  • editorial, review, and automotive information content.

We may add, remove, suspend, or change features at any time.

5. Marketplace role

Auto Car Finder operates as a marketplace platform. We may help users discover, advertise, and enquire about vehicles, but we do not conclude transactions on behalf of users unless expressly stated otherwise.

Any inspection, negotiation, payment, delivery, transfer, trade-in, or finance arrangement relating to a vehicle remains between the relevant buyer and seller.

6. Accounts

Certain features may require a user account. You are responsible for keeping your account details accurate and your login credentials secure. You remain responsible for all activity that takes place under your account.

We may suspend or terminate accounts that are fraudulent, misleading, abusive, inactive, or otherwise in breach of these Terms.

7. Listings and adverts

If you publish a listing or advert on Auto Car Finder, you agree that:

  • the listing is lawful, accurate, and not misleading;
  • you have the legal right to advertise the vehicle;
  • the price, mileage, specifications, and photos are not deceptive;
  • the vehicle is genuinely available unless clearly stated otherwise;
  • you will not post duplicate, fake, placeholder, or spam listings.

We may review, edit, reject, remove, limit, or suspend listings where we reasonably suspect duplication, fraud, unlawful conduct, or breach of our platform rules.

8. Duplicate listings and fraud controls

Auto Car Finder may use automated and manual systems to detect possible duplicate listings, fraud indicators, cloning, or unusual listing behaviour. These checks may include vehicle identifiers, VIN-related data, registration-related data, images, pricing patterns, descriptions, dealership details, and other relevant signals.

We may flag, hold, limit, review, or remove listings where a duplicate or fraud risk is identified. A listing being flagged does not automatically mean wrongdoing, but users must cooperate with reasonable review requests.

9. Fees and paid services

Some services may be free and others paid. Paid services may include listing packages, dealer plans, featured ads, promotions, or other marketplace products.

  • Fees, billing cycles, and product terms will be shown at the point of purchase or in a separate agreement.
  • Pricing may change from time to time.
  • Unpaid accounts may result in suspension of paid services.
  • Unless otherwise stated, fees already used or activated are non-refundable.

10. Content standards

You may not upload, post, or transmit content that:

  • is false, misleading, defamatory, abusive, or unlawful;
  • infringes privacy, intellectual property, or other rights;
  • contains malware, spam, or harmful links;
  • impersonates another person or business;
  • promotes scams, stolen vehicles, or illegal goods.

11. VIN and vehicle data

Auto Car Finder may collect VIN or similar vehicle identifiers for platform integrity, moderation, duplicate detection, and fraud prevention purposes. We may choose not to display certain sensitive identifiers publicly.

Users may not scrape, copy, or reproduce other users’ listing content, stock data, photos, or inventory without permission.

12. Finance tools disclaimer

Any finance, affordability, repayment, or estimate calculator on the platform is provided for general informational purposes only. It does not constitute financial advice, credit approval, or a guaranteed finance offer.

Actual finance outcomes depend on the relevant finance provider, application details, affordability, credit profile, and other requirements.

13. Intellectual property

All rights in the Auto Car Finder platform, branding, code, design, and site content belong to Auto Car Finder or its licensors, except for user-submitted content owned by the relevant user or rights holder.

By uploading content to the platform, you grant Auto Car Finder a non-exclusive, worldwide, royalty-free licence to host, use, reproduce, adapt, publish, distribute, and display that content for the operation, moderation, and promotion of the platform.

14. Platform restrictions

You may not:

  • scrape, crawl, or harvest data from the platform without written permission;
  • use bots or automation improperly on listing, enquiry, or account features;
  • interfere with the platform’s security, code, or operation;
  • reverse engineer or attempt unauthorised access to protected systems;
  • manipulate listing visibility, leads, or moderation systems improperly.

15. Privacy

Your use of Auto Car Finder is also subject to our Privacy Policy and Cookie Policy. Where we process personal information, we do so in accordance with applicable law, including South African data protection requirements where relevant.

16. Disclaimers

The platform and services are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, Auto Car Finder makes no representation or warranty regarding:

  • the accuracy or completeness of listings;
  • vehicle condition, ownership, legality, or roadworthiness;
  • seller identity or conduct;
  • continuous, uninterrupted, or error-free platform availability;
  • fitness of the platform for a particular purpose.

17. Limitation of liability

To the fullest extent permitted by law, Auto Car Finder will not be liable for any indirect, incidental, consequential, special, or punitive loss arising from or related to use of the platform, inability to use the platform, any listing, any user conduct, or any transaction between users.

Where liability cannot lawfully be excluded, our total liability will be limited to the amount paid by you to Auto Car Finder for the relevant paid service in the 12 months before the event giving rise to the claim, or the minimum amount required by law.

18. Indemnity

You agree to indemnify and hold harmless Auto Car Finder, its directors, employees, contractors, service providers, and affiliates from any claim, loss, liability, cost, or damage arising from your listings, your use of the platform, your content, your breach of these Terms, or your infringement of any third-party rights.

19. Suspension and termination

We may suspend, restrict, or terminate access to the platform or services where we reasonably believe a user has breached these Terms, engaged in fraud, abused the platform, failed to pay applicable fees, or created risk for the platform or other users.

20. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or related to these Terms or the platform will be subject to the jurisdiction of the South African courts, unless applicable law requires otherwise.

Good practice: Before formal legal proceedings, the parties should first attempt to resolve the dispute in good faith through written notice and reasonable engagement.
